MoVira Terms of Service (ToS)

1. Agreement to Terms
By creating an account, accessing, or using the MoVira apps, website, or services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.
2. Who We Are
MoVira is a mobility platform that connects riders and independent driver-partners. MoVira is not a transportation carrier; rides are provided by independent drivers.
3. Eligibility & Accounts
- You must be at least 18 to create a rider account and 21 to be a driver.
- Provide accurate information and keep it updated.
- Keep your login secure; you’re responsible for all activity under your account.
4. Driver Requirements (Summary)
- Valid driver’s license (≥1 year), eligible motor-vehicle and criminal record, and successful Checkr background screening.
- Active auto insurance and vehicle registration.
- Vehicle meets local standards and passes inspections as required.
- Active MoVira driver subscription to “Go Online” and accept rides.

5. Payments & Subscriptions
- Rider payments are processed by Stripe (including Apple Pay/Google Pay where available).
- Drivers keep 100% of fares (minus Stripe processing fees). MoVira charges drivers no commission; instead drivers maintain a weekly/monthly subscription via Stripe Billing.

6. Cancellations, No-Shows & Wait Time
Rider cancellations, wait-time rules, and driver compensation are governed by the Fare & Payment Policies (incorporated by reference): movira.llc/fare-policy.
7. Safety & Conduct
- Zero tolerance for alcohol/drug use, harassment, discrimination, or unsafe behavior.
- In-app SOS/Emergency features are available during trips.
- We may investigate safety concerns and suspend or terminate accounts to protect the community.
8. Prohibited Uses
You agree not to:
- Violate any law, misuse the platform, or attempt fraud or fare manipulation.
- Interfere with the Services, reverse engineer, or access without authorization.
- Post unlawful, discriminatory, or harmful content.
9. Privacy
Your privacy matters. See the Privacy Policy: movira.llc/privacy. By using the Services, you consent to our data practices as described there.
10. Intellectual Property
MoVira owns the Services and all related IP (excluding user content). You are granted a limited, non-exclusive, revocable license to use the apps for their intended purpose.
11. Disclaimers
The Services are provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee availability, specific earnings, or uninterrupted service.
12. Limitation of Liability
To the fullest extent permitted by law, MoVira and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability will not exceed the amount you paid to us (if any) in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold MoVira harmless from claims arising from your use of the Services, your content, your violation of these Terms, or your violation of any law or third-party rights.
14. Suspension & Termination
We may suspend or terminate access for any breach, safety risk, fraud, or misuse. You may stop using the Services at any time; some obligations survive termination (e.g., payment of outstanding amounts).
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Oklahoma, USA, without regard to conflict-of-law rules. Disputes will be resolved by binding arbitration on an individual basis (no class actions). You and MoVira waive jury trial rights. Venue for any permitted court actions is Tulsa County, Oklahoma. (If arbitration is not permitted in your jurisdiction, local law applies.)
16. Changes to Terms
We may update these Terms. The “Effective Date” will change when updates are posted. Material changes will be notified in-app or by email. Continued use constitutes acceptance.
